Terms and Conditions

1. About Flygon LC

Flygon LC is a Phoenix-based consulting and technology firm founded in 2020. We provide software and website development, digital advertising, media development and management, and data analysis for clients, generally on a referral-only basis. Public pages on flygonlc.com are informational. A separate written agreement, statement of work, or invoice governs paid client engagements unless these Terms say otherwise.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful, fraudulent, or abusive purpose
• Attempt to gain unauthorized access to our systems, accounts, or data
• Interfere with the operation or security of the Services
• Scrape, reverse engineer, or misuse the Services except as permitted by law
• Upload or transmit malware, spam, or harmful code
• Misrepresent your identity or affiliation
• Use the payment portal to process payments you are not authorized to make

We may suspend or terminate access if we reasonably believe you have violated these Terms.

4. Website and General Content

Content on flygonlc.com is provided for general information about Flygon LC. We may update, remove, or change site content at any time without notice. Nothing on the site constitutes legal, financial, or professional advice. Client work is scoped individually and may differ from examples or descriptions shown publicly.

5. Payment Portal

Our payment portal allows authorized users to submit payments by card through Stripe. By submitting a payment, you represent that:

• You are authorized to use the payment method provided
• The amount entered is correct and intended for Flygon LC or the engagement described to you
• You agree to Stripe’s terms and privacy policy for payment processing

Payments are generally final once successfully processed, except where a separate written agreement with Flygon LC states otherwise or refund is required by applicable law. If you believe a payment was made in error, contact us promptly at [email protected].

We are not responsible for delays or failures caused by Stripe, your bank, card issuer, or other third parties outside our reasonable control.

6. Client Services and Deliverables

Consulting, development, advertising, and related professional services are provided under separate proposals, statements of work, invoices, or contracts. If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls for that engagement.

Unless a client agreement says otherwise:

• Timelines and deliverables depend on timely client cooperation and approvals
• Third-party costs (hosting, domains, ad spend, software licenses, etc.) are typically billed separately
• We may use subcontractors or specialized collaborators on a project basis while remaining accountable to the client

7. Invoice Studio

Invoice Studio at invoices.flygonlc.com is a subscription-based invoicing product with its own account registration, billing, and team features. Use of Invoice Studio is also subject to any product-specific terms, subscription terms, and privacy notices presented in that application. If those terms conflict with this page regarding Invoice Studio, the Invoice Studio terms control for that product.

8. Social Media and Connected Accounts

If you connect social media or advertising accounts to tools we operate, you grant us permission to access and use those accounts only as needed to perform services you request, within the scope of permissions you authorize through the relevant platform. You remain responsible for compliance with each platform’s terms and for the content published through your accounts.

9. Intellectual Property

The Services, including site design, branding, text, graphics, logos, and software (excluding client-provided materials and third-party components), are owned by Flygon LC or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials except as expressly allowed in writing or by law.

Ownership of client deliverables is defined in the applicable client agreement. If no agreement specifies otherwise, Flygon LC retains ownership of pre-existing materials, tools, and know-how, and grants the client a license to use deliverables paid for under the relevant invoice or statement of work.

10. Confidentiality

We treat non-public client information as confidential in the ordinary course of business. Formal confidentiality obligations, if any, are set out in the applicable client agreement. You agree not to disclose non-public information about our tools, pricing, security practices, or internal operations except as permitted by law.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Advertising, software, and consulting outcomes depend on many factors outside our control. We do not guarantee specific business results, rankings, revenue, election outcomes, or platform performance unless explicitly guaranteed in a signed client agreement.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYGON LC AND ITS FOUNDER, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FLYGON LC FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Flygon LC and its founder, contractors, and affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, your connected accounts, your violation of these Terms, or your violation of any law or third-party rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Except where prohibited, you agree that exclusive jurisdiction and venue for disputes relating to these Terms or the Services will be in state or federal courts located in Maricopa County, Arizona, and you waive any objection to such jurisdiction or venue.

15. Changes

We may update these Terms from time to time. The effective date at the top will indicate the latest version. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

16. Text messaging

If you opt in to SMS from Flygon LC, including texts from our toll-free number +1 (844) 944-2869, message and data rates may apply, message frequency varies, and you can reply STOP to cancel or HELP for help. Consent is not required to purchase services. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
